About Eliya Tal, Lawyer and Mediator
The firm of Adv. and Mediator Eliya Tal is leading boutique law firm that offers mediation services in the field of family and inheritance law, including matters pertaining to divorces, separations, marital agreements, joint parenting, domestic partnership agreements, disputes between siblings/parents and children etc. The firm is distinct in the combination between Adv. Tal legal knowledge and perspective and the coaching tools that she spent years acquiring, to provide emotional management and a broad umbrella for clients who seek a service that goes beyond purely legal agreements. As someone with a deep understanding of the challenges and difficulties that the clients go through, Adv. Tal believes in close and personal support across the entire journey.
In the framework of the mediation, the parties are offered a broad review of their parental communication and the expanded family (as applicable), as well as economic, real estate, emotional, child support and more, and Adv. Tal collaborates with the couples to decide how broad should the coverage of each topic be, and reach agreements which are unique to them and their situation, while drafting the relevant legal documents. In light of her background as a lawyer, Adv. Tal also offers legal counsel and legal assistance for mediation processes for individuals who approach her for this purpose rather than mediation management.
One of the firm’s advantages is the fact that Adv. Tal doesn’t represent parties before the courts and accordingly believes that it is in the clients’ best interests to negotiate and reach out-of-court agreements. She believes that, particularly in matters of family, mediation proceedings are the best way to manage a separation or a divorce while minimizing the damage to the spouses and their children.
Adv. Tal was admitted into the Israel Bar Association in 2003 and certified as a mediator in 2006. In the framework of her LL.M. studies (specialization in mediation and dispute resolution) she fell in love with the field of mediation and decided to focus on it in her professional life. Afterwards, she completed the coaching studies program of the Adler Institute and other courses on organizational consulting, parental coaching, parental alignment, and more.
The Visionary and Founder of the Adler Institute Mediation School
Adv. Tal founded the Adler Institute Mediation School and is actively managing the expansion of its trainings in the field. To date, the school has trained about 600 mediators and the team of mediators under her supervision includes 8 active and experienced mediators).
She formerly taught mediation also in Bar Ilan University, and overall she instructed and coordinated dozens of mediations and family mediation courses to date. She also serves as a professional mentor for newly certified family mediators, in their first or in complex mediation processes.
Adler Institute’s Mediation Studies Program won the public tender for IDF Retirees and Workers of the HIstadrut. Adv. Tal takes great pride in the Mediation School’s continued role in promoting mediation and its distinct language to the wider public. The school certifies mediators in every field including family mediators, from the worldview that sees relationships in general and family relationships in particular as an absolute value, and creates a mediation for managing family relationships beyond the legal agreement. In addition, over the past year, the school opened specialized courses for LGBT family mediation and pedagogic mediation for integration the mediation language into education framework.
Preserving the Relationships of the Parties, Their Children and the Extended Family
Following her entry into the mediation field, Adv. Tal understood that the language of mediation serves as the best tool for managing conflicts in a constructive manner. Ever since, she has been working to raise awareness and familiarity with this field, and she lives and breathes mediation in her everyday life, believing that it creates effective communication and is meant not only for resolving conflicts, but also for preventing them. The firm’s family mediation processes are based, first and foremost, on preserving the relationships of the parties, their children and even the extended family. Thus, with a broad perspective that understands also the emotional challenges, rather than focusing on economic-legal aspects, Adv. Tal accompanies the spouses and their families in creating long-term agreements that would preserve and even improve the new post-separation relationships.
Business Mediation for Executives
Beyond her activity in family mediation and as part of her worldview that sees a direct connection between lasting and beneficial relationships and personal growth and welfare, Adv. Tal personally works with senior executives in order to improve their communication and conflict management skills in the organization, and also works with organizations in personal and team meetings, workshops and courses, to promote specific goals in accordance with the needs of the organization.
Unique Practice Areas
Tech and Complex Properties – over the past few years, as the Israeli tech industry evolved, a growing need emerged for managing complex capital that couples accumulated over the course of their shared lives. Adv. Tal manages mediations that require separation of complex properties, such as holdings in companies, real estate and cross-border properties. In such mediations, where necessary, Adv. Tal works with a variety of economic experts and managers of family wealth, to create property agreements that express the wishes of the parties and their desired lifestyle.
Divorce and Business – Divorce mediation processes for couples who jointly manage a business or a company, can open numerous options such as selling the company, separating the partnership, but also the option of remaining active business partners. Such mediations include a commercial part that covers the management of the company, the division of responsibilities, the decision-making process and the active employment of one or both spouses. Such decisions, which are often made in the divorce mediation, require additional actions before the company’s Board of Directors, amending the articles of association and more, through additional professionals.
Parents of Special-Needs Children – mediations in such cases are challenging and require particular sensitivity. In the management of such proceedings, with the parents’ agreement, Adv. Tal often consults with the professionals who treat the children and have recommendations which are tailored to the children and their unique needs. This opinion from the professionals provides new perspectives in the mediations and a deep and professional understanding of the children’s needs. In collaboration with the parents, a detailed and accurate parenting plan is created, prioritizing the children’s benefit and respecting the wishes of the parents and the entire family.
