The office was founded in 2002 by Attorney M.D. Shai Feuering and it stands out for the fact that he represents only prosecutors, hence patients or patients’ relatives who are suing the medical establishment. A Doctor Who Decided to Act as a Voice for Patients Who Experienced Malpractice
Prior to establishing the office, Attorney Feuering served for 8 years as an intern physician in Cardiac Surgery unit in Soroka Medical Center (Graduate of Medical Studies in Ben-Gurion university from 1990). In parallel with his internship, he graduated Law Studies and at the end of that term decided, out of a sense of mission and personal insights, to become a voice for patients who experienced medical malpractice. The office with Dr. Feuering’s lead, makes sure to hand-pick cases it represents, only in cases it is understood that the damage done occurred due to medical service, given unreasonably or carelessly. In addition to his on-going activity in the office, Attorney Feuering acts as an adjunct lecturer at Ben Gurion University in the field of medical law in general, and medical risk management in particular. He is a member of the Society of Medicine and Law in Israel, member of the damage’s forum of Israel Bar Association and is involved in sub-committee for medical malpractice matters.
Attorney Feuering is frequently invited to lecture in different frameworks in front of lawyers, doctors and medical staff on the topic of medical malpractice. He is invited also as an expert in the field of medical malpractice to participate in professional conventions, TV shows, to appear in different Knesset committees dealing with medical malpractice, and from time to time writes a commentary on the subject in newspapers. Dr. Feuering is also a volunteer instructor in Yad-Vashem on the subject of Medicine and Holocust and instructs delegations to Poland on behalf of Yad-Vashem. In the past, He served as Member of the Disciplinary Tribunal of the Southern District Bar Association.
An Office That is Home
Over years the office has gathered reputation as a legal authority in the field of medical malpractice and, as of today, counts 4 lawyers, among them are former doctors and former nurses, dealing exclusively with cases of medical malpractice. Representation in Inspection Committees
Alongside the damage claim appearing before court, in appropriate cases the office finds it right to turn also to the Ministry of Health, in demand that an ‘Inspection Committee’ will be formed to examine adequacy of treatment. If the Ombudsman in the Ministry of Health accepts this demand, an inspection committee is formed to investigate details of the medical treatment. For that reason, the ombudsman appoints doctors as committee members, whose expertise is needed to investigate the specific medical occasion and a committee member, who is a lawyer, of behalf of the Ministry of Health.
The committee summons the involved (the patient, his family and the medical staff who took part in the treatment) to appear before it. After the hearings are over, the committee comes to any conclusions regarding the nature of treatment provided. Its conclusions and recommendations the committee passes to the patient and to the medical staff. In extremely severe cases the Minister of Health revokes the respondent Doctor’s license, sometimes permanently.
Along the years, the offices has initiated dozens of inspection committees. Along the rest, in these cases: A woman passed away from an infection two days after a surgery to remove a benign lump; A woman who was paralyzed in both legs due to late diagnosis of a benign lump in the backbone; A passing of a patient in the X-ray room after an injection of an anesthetic caused raspatory depression; A suicide occurring because the health maintenance organizations deny purchasing medication that was recommended upon release from hospitalization, and more.
Additional Prominent Cases
Negligent disregard from an unusual laboratory test indicating a cancer in the prostate - A claim of inadequate treatment of cancer – An irregular an alarming blood test result to locate a prostate cancer was not reported to the patient and not treated, and only after 10 months, and after the tumor’s spreading was so wide it was not treatable, it was discovered he suffers from prostate cancer. The patient died of the illness 2 years later.
