Several transformative rulings were made in favor of the firm’s clients, including one of the only cases (if not the only one) where a minor girl was declared as a “Shtokee”. In addition, Adv. Pascal won a custody case for a father over his three underage children and managed property, child support, and custody lawsuit for a senior official in the Ministry of Defense.
The firm also managed a years-long monetary claim between sisters, concerning the winning of a sum of NIS 18M in the Israeli lottery, and several cases concerning the immigration of minors to the USA, with the resolution of the minors’ immigration.
Divorce and Marriage Contracts
The handling of a divorce case requires a profound knowledge of the full spectrum of related areas, as well as sensitivity and the capability of bringing the couple to realize that a good-spirited divorce, while maintaining mutual respect, benefit all sides, and most of all express the effort for keeping the interests of the children. Occasionally, in the framework of the divorce process, the issue of executing the Ktuba (Jewish marriage contract) also arises.
Property and Resources Balancing
The division of property is one of the main issues for separating couples. This issue raises disputes between the spouses, whether if it concerns the division’s method or its very necessity. Our firm handled and handles complex cases concerning a lot of property and complex issues, including social and pension rights, the liquidation of partnerships, resources balancing, etc. The firm won, inter alia, a revolutionary ruling that ordered an unequal distribution of property in the wife’s favor, and other significant rulings.
Child support for underage children is usually paid by the father, by the Jewish law that determines the father’s obligation to care for the needs of his underage children. The guiding principle is that when evaluating the required child support from a father, the needs of the children must be taken into account, as well as the father’s salary, economic status, and needs. In addition, when setting the child support, the court will balance between the obligator’s economic status (including property) and the needs of the eligible party.
The firm handles alimonies to exhaust the rights of women for support by the standard of living they were accustomed to, and of men to prove the existence of sufficient reasons for justifying their refusal, by proving that the woman doesn’t meet the criteria for alimony.
The firm handles many cases that revolve around the issue of custody. Just recently we won a revolutionary ruling, where the father – our client – received exclusive custody over three minor children. Nowadays, the court often rules for joint custody, which also affects the father’s child support payments. The firm handles all types of custodies.
A claim for regaining marital harmony is within the jurisdiction of the Rabbinical Court, the only authority where such a claim may be filed and conducted. Such claims often have implications on alimony, division of property, specific housing, etc.
