Recently, the Regional Labor Court ruled in favor of the employee who worked only for 14 months, awarding compensation of 150% from the day of dismissal until birth, plus an additional 150% compensation for the protected period after birth. Additionally, the court awarded the client of the office 40,000 Nis for wrongful dismissal and another 10,000 Nis for legal expenses.
In another case where the office represented a new pregnant employee who was hired as an accountant manager, the Regional Labor Court ruled in favor of the employee, considering pregnancy as a significant factor in the decision to dismiss the employee and the timing of the dismissal before six months of employment. Accordingly, the claim was partially accepted: the employer was ordered to pay the employee compensation equivalent to her salary until the birth date and an additional amount of 95,000 within 60 days after maternity leave, as well as compensation without proof of damages totaling 10,000 Nis.
In addition, the Ministry of Education was obligated to compensate for the wrongful dismissal of a kindergarten teacher who was terminated in pedagogical layoffs. She was awarded a total of 180,000Nis plus 20,000Nis legal fees. Another teacher who was dismissed prior to receiving tenure, was granted tenure by the Ministry of Education. With the assistance of her attorney, Orna Shmaryahu the court determined that the proceedings against her stemmed from extraneous considerations.
