Selected Rulings

Uri Gilboa and Co. Law Office has obtained many rulings to its credit, including the following:

Medical Malpractice

• 3.4 million NIS was received in a settlement of a lawsuit against medical malpractice during a head surgery.
• 5.5 million NIS (3.65 net) was received in settlement of a lawsuit against a prestigious hospital that mishandled the childbirth, leaving the girl with cerebral palsy.
• NIS 4.3 million was awarded to the firm’s client in a lawsuit against attorney Amos Givon, who was negligent in managing a medical malpractice lawsuit.
• 3 million NIS in damages due to negligence in the repair of urine leaks during surgery.
• NIS 2.5 million was awarded to a family who lost their daughter during childbirth as a result of a uterine rupture caused by the administration of Pitocin. Data from a previous birth that would have revealed a narrow uterine canal was not reviewed by the medical staff.
• 2.7 million NIS was awarded for injuries caused by negligence to a 76-year-old woman who lost her kidneys following a simple urinary incontinence operation. The court ruled that the sequence of events points to serious mistakes made by Hadassah in treating the plaintiff, which led to the challenging situation the plaintiff reached, and there is no reason to attribute to the plaintiff “contributory fault” or to avoid minimizing the damages.
• NIS 2.2 million was awarded to the family of a mother who gave birth and was discharged home after suffering an undiagnosed stroke and died. The deceased’s family filed a medical malpractice lawsuit against the hospital through its lawyers Uri Gilboa and Amit Aryeh, claiming that effective medical treatment could have been provided had the required tests been performed on time.
• NIS 2.2 million in settlement for a 6-month delay in diagnosing lung cancer.
• NIS 1.5 million was awarded to parents who lost their daughter during childbirth due to infection. The hospital failed to perform the required tests and ignored the need to provide prophylactic antibiotics.

Work Accidents, Traffic Accidents and Lawsuits Against the Israel Police
• NIS 3.3 million was awarded as damages against the Israel Police (Police Investigation Department) for failing to prevent a murder.
• NIS 2.6 million was awarded to a citizen injured by the Israel Police.
• NIS 3.5 million was settled in the lawsuit of an employee who was killed by an excavator overturning during the construction of the Egyptian border fence.
• NIS 3.6 million was awarded to the surviving family members of a kibbutz member, who was electrocuted to death due to the kibbutz’s negligence.
• NIS 4 million was awarded to a construction worker from the West Bank who fell, leaving him disabled.
