The Firm’s Area of Practice
The firm provides first-class legal services in courts of all levels, family courts and rabbinical courts, in the field of divorces, including dispute resolution proceedings, opening a divorce case, expedited divorce proceedings, divorce (“Gett”) refusal, common law marriages, complex cases of custody and visiting arrangements, balancing of resources, including external properties that were accumulated before the wedding, dissolution of real estate co-ownership in all of the properties including the residential apartment, child support and alimony, reducing child support, marital agreements and cancelations thereof, and more. In addition, the firm has vast experience in handling complex and difficult inheritance disputes, management of estate proceedings, scope of estate claims, and opposition to the execution of a will. The firm also practices intergenerational transfers to complete its comprehensive estate and inheritance practice.
The firm has a particular expertise in cases where one of the spouses is part of the “shadow economy” and makes a living off “unreported cash”, which makes exposing their assets difficult, and this is first and foremost an evidence problem. Unlike money held in bank accounts, pension funds, provident funds or real estate, for which records are available, shadow economy activities are manage, by their very nature, off the records, whether if the spouse knows about them or not, or lacks the knowledge about the full scope of the funds, assets or location thereof, which may be in a safe, Israeli or foreign bank accounts and properties that may registered under a third party name in order to hide the true ownership for various reasons. In addition, the firm has extensive experience in managing and accompanying divorce proceedings where one of the spouses has properties abroad, from the aspects of both preventing the “disappearance” of the properties and liquidating such properties.
The firm has a particular expertise in all aspects of the balancing of resources between divorcees. This may include cases where one of the spouses didn’t work while the other’s career thrived, where the career assets must be valued to balance the resources and dividing the assets equally between the parties. Adv. Aviv Harel graduated from the Faculty of Law of Tel Aviv University in 1995, and was admitted into the Israel Bar Association in 1996. He is a certified notary, certified to prepare continuous Power of Attorney qualification, and a member of the New York Bar Association.
Adv. Harel has vast experience which was accumulated through the management of hundreds of cases and thousands of complex proceedings, in courts of all levels, in the fields of divorce, family law, inheritance and estates. The firm also has deep knowledge and extensive experience in managing disputes pertaining to custody, visitation arrangements, alimony and child support disputes and all aspects of parental alienation.
Adv. Aviv Harel remains constantly abreast of the latest legislation amendments and rulings, and for this purpose he meticulously maintains a comprehensive professional reference archive that includes, inter alia, legal literature and access to professional legal databases.
