Throughout his many years in the profession, Attorney Feldstein has represented thousands of victims in complex legal situations particularly prominent representation in National Insurance claims. Attorney Feldstein graduated with a bachelor’s degree in law (dean’s distinction) from the University of Haifa and later completed a master’s degree in business administration also at Haifa University. He has been a member of the Bar Association since 2000 (he received one of the highest marks in Israel in the bar exams) and worked for several years at a well-known attorney’s office in the field of tort law and National Insurance. In 2004, he ventured out on his own and founded a successful firm, where he still stands at the helm today.

Significant Successes in Complex Lawsuits Against National Insurance

Attorney Feldstein is known for his determination, and with his experience and legal tools, he manages to win cases in the various courts. He operates with transparency, examining each case thoroughly and decides whether or not there is a chance for the clients to win the lawsuit. He is not afraid to take on difficult and pioneering cases, heard by the courts for the first time, and then building the case and appealing to the National Insurance Institute if necessary. If the claim is rejected, he does not give up and continues to pursue it through the regional labor court and, if necessary, through an appeal to the National Tribunal.

Prominent Legal Precedents

Work-Related Heart Attack Due to Workload - The firm represented an individual who suffered a heart attack and sought to recognize the medical event as a work accident. After a long legal process, including court hearings that convinced the court that the plaintiff experienced an unusual workload on the day of the heart attack, the court appointed a medical expert who established a causal link between the workload and the heart attack, arguing that the client suffered from multiple risk factors. Following a series of questions posed by the office to the expert, the team managed to convince the court that another expert should be appointed, and it was established that indeed there was a causal link between the workload and the heart attack. The financial implications were significant and were realized through medical testimonies presented during the legal process.

Worker Exposed to Metals, Developed Parkinson’s Disease - Representing an individual who worked for many years exposed to metals and developed Parkinson’s disease. After years of litigation with appeals to the national tribunal and the appointment of several experts, the firm was able to prove the causal link and win the case. In fact, at some point, the Regional Court asked Attorney Feldstein when he would accept the position of the experts who denied the causal relationship and waive, but he did not give up, and indeed won the lawsuit.

Refinery Workers Contracted Bladder Cancer - The firm represented several refineries employees who claimed that due to their work, they contracted bladder cancer. Unfortunately, a medical expert who initially examined their case determined that there was no causal connection, and at this stage the firm took action and succeeded in proving the causal relationship, leading to a verdict recognizing them as ill due to their work. As a result of the verdict, some of them were awarded millions of shekels in compensation (depending on each one’s medical condition).

A Football Player Recognized as a Work-Related Injury - The firm represented a young and talented football player, playing the national league, who was recognized as a work victim, despite that he did not receive a salary, but only a reimbursement of expenses (played for free and worked a different job). During the league match, he suffered serious injury and the National Insurance claimed that he should not be considered an employee and rejected his claim. Attorney Feldstein appealed to the labor court, which accepted his claims and even determined that the player should be recognized as an employee in all respects. This ruling is significant because there are many young athletes who only receive expense reimbursements, so now they can be confident that if, God forbid, they are injured during a game, they can receive compensation from the National Insurance Institute.

Legal Precedents

The Avraham Fis Act - Over the years, the office has succeeded in achieving several legal advancements, including an act dealing with the aggregation of disabilities resulting from micro-trauma - a cumulative damage disease. This advancement allows (in certain situations) to merge separate disabilities that individually do not grant benefits, into one disability that grants benefits, and allows a transition from a disability that grants a one-time benefit to a disability that grants a monthly allowance.

The Family Lost Their Home Due to a Car Accident- Attorney Feldstein represented a family that lost their home in a serious accident. In this case, the question arose as to whether it was intentional damage so that it would not be considered a car accident. After the Magistrate’s Court ruled that it was not a car accident, and Attorney Feldstein appealed to the district court, contrary to the majority’s opinion, overturned the decision, and a request for permission to appeal to the Supreme Court was rejected. This ruling is considered an advancement of its kind and will be studied in road accident courses at law faculties.
