Selected Cases
Medical malpractice during pregnancy follow-up leading to the birth of a deaf child - The firm represents a minor born with severe and irreversible deafness due to malpractice by an HMO during the mother’s pregnancy. At the beginning of the pregnancy, the mother was found to lack antibodies to CMV (a virus from the herpes family which usually causes only mild symptoms in pregnant women but may endanger the fetus and cause severe defects), and she did not receive the necessary instructions and explanations from her gynecologist that could have prevented infection through very simple preventive actions. Ultimately, the mother contracted the virus, which was transmitted to the fetus and left him with severe disability. Currently, in mediation, it has been proposed to settle the claim for approximately nis 3,000,000 before deduction of National Insurance benefits.
Double medical malpractice during childbirth - The firm represented a woman in her thirties in a severe case involving two failures: failure to diagnose a large, retained placenta and negligent misclassification of a grade 3C anal sphincter tear as grade 2. As a result of the improper treatment, including suturing under suboptimal conditions by a non-specialist physician, the plaintiff (a software developer) was left with severe disability manifested in loss of sphincter control, serious harm to her quality of life, fertility, and mental condition. Despite its complexity, the case was resolved in less than two years with compensation of 1,350,000 nis.
Pressure applied to a laboring woman’s abdomen resulting in 1,000,000 nis compensation - During the pushing stage of labor, two staff members leaned their arms on the upper abdomen of the woman without prior preparation or warning and applied strong, aggressive pressure. After delivery, she complained of gas incontinence and was diagnosed with a grade 3 tear. The firm filed a claim arguing that such pressure is prohibited and dangerous, causing uncontrolled delivery of the baby’s head and potentially severe harm to both mother and newborn. The case ended with compensation of 1,000,000 nis shortly after filing.
Two severe malpractice incidents within one week leaving a young mother permanently disabled - The firm represents a 19-year-old mother who became permanently disabled due to a series of medical failures within one week. First, after a cesarean section complicated by infection, she was discharged without anticoagulants (Clexane), despite being in a high-risk group due to obesity, surgery, and severe infection. Second, a few days later, she returned to the hospital with severe pain and a referral to rule out thrombosis, yet she was discharged with merely painkillers. As a result, she developed severe deep vein thrombosis and pulmonary embolism, becoming dependent on crutches, unable to work, and limited in daily functioning. The claim has been filed and is currently in finalizing negotiations.
Abnormal genetic test leading to the birth of a baby with severe defects - The firm represents a minor born with severe defects due to malpractice by those treating the mother during pregnancy, who recommended a NIFTY test instead of amniocentesis despite her age (41). The test yielded a normal result despite a significant chromosomal deficiency that should have been detected. Additionally, defects that should have been identified in prenatal screenings were missed. The claim was filed against the HMO and the laboratory in China that analyzed the NIFTY test. The firm saved the parents substantial costs by obtaining court approval to serve the claim to the lab’s representative in Israel instead of translating and delivering documents abroad. The case is currently in mediation.
