Duns 100 Forum for Leading legal Commercial Litigation 2026
Israel’s leading commercial litigation lawyers met to discuss the issues shaping the resolution of business disputes.
On Tuesday, 20 October 2026, Duns 100 held its forum for leading commercial litigation lawyers at the Dan Tel Aviv Hotel, with senior representatives of Israel’s leading law firms in attendance.
The forum brought together leaders in the field for a timely professional discussion of changes in the management of commercial disputes, the responsibilities of corporate decision-makers, and the challenges facing lawyers and their clients in a changing business and legal environment.
The discussion focused on the impact of artificial intelligence on litigators’ work, court backlogs and pressure to settle, the liability of directors and corporate officers, shareholder disputes, and developments in contract law jurisprudence.
A Professional Discussion with Israel’s Leading Commercial Litigators
The forum was led by Ido Leder, Vice President, Duns 100, and Shila Zavaro Weiss, Senior Director, Strategy and Ranking. The discussion was moderated by Dafna Shahar, a presenter on Israel’s Economy Channel.
Participants examined the tension between procedural efficiency and the parties’ right to a judicial determination, the limits of judicial intervention in business decisions, and the impact of technology on litigation strategy, law firm operations, and professional responsibility.
“The struggle for the independence of the judiciary was not merely a civic struggle, but a professional struggle of the highest order. We will persist in it.”
Amit Becher, Adv., President of the Israel Bar Association and Partner at S. Horowitz & Co.
Forum Highlights
Artificial Intelligence in Litigation Practice
The impact of AI tools on document analysis, legal research, and the development of legal arguments, alongside changes in the management of litigation departments and fee arrangements. The discussion also addressed the verification duties and professional responsibilities associated with using these tools.
Court Backlogs and Commercial Settlement and Mediation
Participants discussed the impact of court backlogs on case management, changes in commercial mediation, and the timing of settlements. They also examined the line between encouraging an agreed resolution and pressuring parties to settle at the expense of their right to a judicial determination.
Directors’ Liability and the Business Judgment Rule
The discussion examined the weight to be given to business outcomes versus the quality of the decision-making process, the boundary between legitimate business risk and recklessness, and directors’ independent oversight duties, including when relying on management and external advisers.
Derivative Actions and Document Disclosure and Independent Committees
The discussion focused on the evidentiary threshold for applications for document disclosure before a derivative action, the independence and composition of litigation committees, and the appropriate degree of judicial scrutiny of their recommendations to conclude proceedings.
Partner and Shareholder Disputes
Participants addressed the strategic differences between representing minority shareholders and controlling shareholders, shareholder oppression claims, company valuations, and how these factors influenced the handling of disputes and the prospects of reaching a settlement.
Contract Law and the Balance Between Flexibility and Business Certainty
The discussion addressed developments in the Supreme Court’s contract law jurisprudence, including the Patriarchate judgment and the decision on the petition for a further hearing, and their implications for contract interpretation and the parties’ ability to assess risks in advance.
Litigation in a Changing Economic Environment
Participants examined the impact of real estate market conditions, interest rates, delivery delays, and corporate financial distress on commercial disputes, alongside third-party litigation funding and the complexities of disputes involving cryptoassets and digital currencies.
Compliance with Court Orders and the Protection of Lawyers
Participants raised the implications of non-compliance with court orders and the issue of threats and harassment against lawyers in civil proceedings, including their impact on the conduct of proceedings and legal representation.
