Family Law Forum 2022
As part of the forum, which is considered one of the most stormy and fascinating forums we hold every year, we dealt with issues on the professional agenda in the field of family law, among them: the memorandum of the alimony law, the need to establish an economic court for family matters, the publicity of the hearings and increasing the scope of publication of judgments at the initiative of the judges.
Ariel Schreiber opened the forum and gave congratulatory words, after which Efrat Segev presented interesting data about the field of family law and the legal branch in Israel, including the percentage of gender representation among law firms operating in the field and the various trends that characterized the field of family law in the past year.
Attorney and mediator Amy Bakhor, owner, Amy Bakhor Boni law firm: "The idea of establishing an economic court in itself is an excellent idea and has even proven itself in the commercial field. At the same time, in family law as long as there is a power race between the religious court, the The rabbinic court, and the civil court, is it a court for family matters, the establishment of an economic court could deepen the gaps between the litigants, since the rabbinic court has judges who have no legal or economic education and the choice of court can be fateful and worth a lot of money, therefore, the stronger party will try Seizing authority in the Rabbinical Court and thereby infringing on the rights of the other party. At the same time, there is no escaping the search for a solution to the difficult problem in which, according to the situation today, the Family Court hears huge financial cases when it does not have the ability or knowledge to do so."
Advocate and mediator Arthur Shani, partner, founder and manager of A. Zisman Shani - Law and Mediation - Law firm regarding the maintenance law memorandum: "The involvement of the legislator in family cases should be reduced as much as possible. We need to learn from the LGBT community, that parentage agreements, cohabitation agreements are made beforehand. Instead of encouraging the Knesset to enact idle laws, the people should be encouraged to sign agreements in advance that will prevent friction and fights later on.'
