A class action lawsuit for reserve duty payments and discrimination was dismissed without any compensation- The firm represented a company in response to a motion to certify a class action in the amount of NIS 11 million filed against it, on the grounds of non-payment of reserve duty benefits in accordance with the law and discrimination against employees serving in the reserves. A detailed response was submitted in which it was proven to the court that the company was acting lawfully with regard to the payment of reserve pay, that there is no discrimination whatsoever towards reservists, that the company acts lawfully with regard to the payment of reserve benefits and that the dispute is not suitable for a class action in the absence of a group and the absence of a chance that the claim will be decided in favor of the group. As part of the hearing on the motion for approval, the Labor Court recommended to the class plaintiff’s attorneys to dismiss his claim (after receiving additional data from the company), and indeed the claim was dropped without the company being required to pay anything.
Representation of a former CEO in a claim filed against him by the company for an alleged embezzlement of the company’s funds and using them for personal purposes – representation of a former CEO who discovered, to his surprise, one bright day, that the company’s owner and chairman of the board wishes to fire him and take his job. The dismissal was unlawful, without a hearing and after only three days earlier the CEO’s far-reaching terms were agreed upon, including a prolonged early notice of 6 months and financial rights in case of a sell of the company. The CEO demanded his rights and during a negotiation for a work termination agreement, the chairman of the board “revealed” the use allegedly done by the CEO with the company’s funds for his own personal purposes, while denying the documented agreements of the parties in this matter throughout the entire period of employment. In the beginning it was claimed that it is a sum of about NIS 600,000 and this sum climbed and reached during the legal demand to more than NIS 2 million. In the framework of the representation a legal counter claim was served for the payment of the CEO’s rights according the agreements with him, for a sum of more than NIS 1 million. The case is still ongoing.
