Commercial Litigation Forum 2022
As part of the forum, the branch's senior officials dealt with and discussed issues on the professional agenda, including the erosion of public trust in the justice system and the ever-increasing criticism in the shadow of the election period, the denial of the possibility of the federal courts to issue documents disclosure orders in international arbitration proceedings, the pace of activity of the courts and tribunals in closing cases and the fine line between defense to a media spokesperson.
Some interesting headlines that came up during the heated discussion:
Attorney Baruria Lekner, senior partner, Ben Shahar Lekner & Co., law firm on public trust in the legal system and the reform presented by the religious Zionist party regarding the indictments against Netanyahu: "The legal system is not perfect and corrections must be made to it. But what do the members of the Knesset and the lawyers do? They ride on the growing difficulty of the citizens to believe in the justice system. As soon as the public knew that the meaning of the reform is that they make corruption a governing norm, in that basically every elected official will be able to receive money and benefits for his private needs, without giving a report. No citizen or lawyer will agree to this. I call for the mask to be torn from the face of this fake reform.'
Attorney Tzafir Negbi, founding partner and head of the litigation department at the firm Negbi, Cohen, Eyal & Co. commented on the new initiative of the religious Zionist party: "The proposed proposal has clear goals and motives and is the self-destruction of the system. At the same time, it must be admitted that parts of the system do deserve criticism and also that the level of judgment in Israel is not uniform. Therefore, if my opinion had been heard, I would have returned the judges' feedback. This is an important tool and the only place where we could give our input on the system"
Ran Shaprincek, co-director of the litigation department, Erdinst, Ben Natan, Tolidano & Co. on the subject of the method of appointing judges in Israel: "The method of appointing judges in the State of Israel is an excellent method. It has a balance and in the result test our system is very autonomous. It is very little affected by external factors. In recent years, the system has become politicized and this must be fought. We were exposed to the phenomenon of lobbying by certain judicial candidates that led to bad places. This must not happen - secret contacts with members of the committee should be prohibited.'
